Monil online shop is specialized in the manufacture of leather goods accessories. Any order taking under a product appearing within the online shop implies the acceptance of the present general conditions. The present Conditions apply to any sale of products presented on this site. Consequently, the consumer acknowledges being perfectly informed of the fact that he/she agrees with the contents of the present general terms and conditions of sale and does not require a handwritten signature of this document insofar as the customer wishes to order online the products of the Monil online store. The Customer declares to have taken knowledge of it at the time of the placing of the order. Any order placed on the Monil website implies unconditional acceptance of these conditions.

Article 1 – Products

Monil products are hand made in France.

There may be slight manufacturing differences from one product to another, but they will always be faithful to the photographs proposed by the site. The photographs on the site are as faithful as possible but cannot be contractual: the colours vary according to the light, the use of natural leathers means that two products will always be very slightly different, and the hand work also gives a unique character to a product. We always try to describe the product as best we can but it is up to you to check that it corresponds to your own needs and to those to whom you determine the product. The acquisition of a product through this site implies the buyer’s unreserved acceptance of these terms and conditions of sale. As such, the buyer acknowledges having read these terms and conditions of sale and agrees to accept them. Monil reserves the right to modify its conditions of sale at any time.

Article 2 – Prices 

Monil reserves the right to modify its prices at any time, it being however understood that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated on the site are inclusive of tax (all taxes included). Postage and packaging costs are included in the prices indicated, except in exceptional cases. They are mentioned before validation of the order and invoiced unless otherwise specified in addition. Any tax not indicated during the ordering process remains payable in any case, in view of the applicable legislation and at your exclusive charge (for example customs duties). Article 3 – Order  

The buyer, who wishes to purchase a product or service, must therefore obligatorily :

– Fill in the identification form on which he will indicate all the requested information.

– Validate your order after having checked it.

– Make the payment in accordance with the conditions provided for

– Confirm your order and payment. The confirmation of the order is valid as a contract of sale, entails acceptance of these terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation to avail oneself of one’s own terms and conditions of purchase or other conditions. All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.

Unless otherwise stated, all transactions are made through PayPal or by credit card (via Paypal) in order to secure all transactions on the site. The buyer may be subject to specific conditions attached to the means of payment he chooses. All these means of payment are published and carried out by third party companies. Thus, the seller never has access to the buyer’s banking data. Also, in order to fight against fraud, the seller has implemented procedures to verify orders. These means can make it possible to block and, if necessary, cancel an order if fraud is detected. Likewise, the seller reserves the right to refuse to make a delivery or to honour an order from a buyer with whom a dispute is in progress. In certain cases, particularly for non-payment, incorrect address or any other problem related to the buyer’s account, the seller reserves the right to suspend the order until the problem is resolved.

To finalize the order, the buyer must click on “Finalize Order”. He acknowledges that the fact of placing an order implies an obligation to pay. The absence of payment prevents any formation of the order. Your order confirmation leads to the conclusion of a contract between the seller and the buyer.

Article 4 – Means of payment  

Different methods of payment are accepted:

– Credit card via Paypal, which uses a secure protocol so that the information transmitted is encrypted by software and no third party can see the transfers on the network.

Article 5 – Deliveries

In the absence of any indication or agreement to the contrary as to the delivery date, the seller undertakes to deliver the products ordered by the buyer within fourteen (14) calendar days after payment of the order. Exceeding this period shall not give rise to a claim for damages. Delivery is made by transfer of physical possession or control of the product and will be made to the address indicated by the buyer. It will be worth the transfer of ownership. The buyer acknowledges that the transfer of ownership of the goods can only take place upon receipt of the full price by the seller. The delivery of the product(s) will be made either to the buyer or to a third party designated by the buyer.

Article 6 – Withdrawal

In accordance with Articles L.121-16 and following of the Consumer Code, the consumer has a period of 10 working days from the date of delivery of his order to return any item that does not suit him and request an exchange or refund without penalty, with the exception of return costs.

The items provided by the Monil site are new and guaranteed against any defect. However, if you consider that one of your items is defective or not in conformity or in case of error in your order, you have a period of 10 days from the date of receipt of the package to contact the company Monil by email at the following address: monil.made.in.france@gmail.com and we undertake to exchange or refund you provided that it is returned in its original packaging and not worn to the following address: 22 bis rue du docteur Calmette – 21000 Dijon (France). Items returned incomplete, damaged or soiled will not be refunded or exchanged and will be returned to you.

In the event of a refund, Monil will reimburse the full amount of your order within a maximum of 30 days, as provided for in Article L. 121-20-1 of the French Consumer Code, following the date of receipt of the returned package, except for the return costs which remain at your expense.

The customer will communicate to the company Monil his bank details. The company Monil strongly recommends that the customer returns his products by colissimo with a recommendation or an additional insurance guaranteeing, if necessary, the compensation of the products up to their real market value in case of loss of these goods.

Article 7 – Liability

Monil cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which could result from the misuse of the products marketed. It is the same for possible modifications of the products resulting from the suppliers. The responsibility of Monil shall, in any event, be limited to the amount of the order and shall not be held liable for simple errors or omissions that may occur despite all precautions taken in the presentation of the products.

Article 8 – Intellectual property

Monil is a protected trademark registered at the INPI and www.monil.fr is a domain name also protected. No one is authorized to reproduce, exploit, distribute or use for any purpose whatsoever, even partially, the elements of the site, except with the written consent of the company Monil. All the elements present on the Monil site are and remain the intellectual and exclusive property of the Monil company. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site. Monil is the holder of the intellectual property rights on the site and the right to disseminate the elements appearing on the online store. As such and in accordance with the provisions of the Code of Intellectual Property, the partial or total reproduction, on any medium whatsoever, of the elements comprising the site and product catalog, their use and their availability to third parties are strictly prohibited.
